PRÉAMBULE

Les présentes « Conditions Générales de Vente » s’appliquent aux opérations juridiques portant sur les produits commercialisés auprès de ses clients par MATTHIEU TORDEUR EURL au sein de sa boutique virtuelle.

DEFINITIONS

The following words or expressions shall have the following meanings in this Agreement:

Online Store: refers to the MATTHIEU TORDEUR EURL website on which Products are displayed and sold to customers.

Order: refers to the sales contract concluded between MATTHIEU TORDEUR EURL and the customer of the MATTHIEU TORDEUR EURL online store.

Product description: refers to the classified information about a product provided by MATTHIEU TORDEUR EURL when the product is offered for sale in its online store.

Products: refers to all goods and services offered for sale by MATTHIEU TORDEUR EURL in its online store.

Service: refers to the sale of Products by MATTHIEU TORDEUR EURL to customers of its online store.

Transaction: refers to all operations, secure processing, authorizations, and agreements inherent in the payment of the price of Products ordered by credit card.

ARTICLE 1 – PURPOSE

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which MATTHIEU TORDEUR EURL offers and sells its Products to its customers.

These General Terms and Conditions of Sale shall prevail over any other terms and conditions contained in any other document, unless expressly agreed otherwise in writing in advance.

ARTICLE 2 – ACCEPTANCE OF TERMS AND CONDITIONS

The customer acknowledges having read, at the time of placing the Order, these General Terms and Conditions of Sale and expressly declares that they accept them without reservation.

These general terms and conditions of sale govern the contractual relationship between MATTHIEU TORDEUR EURL and its customer, both parties accepting them without reservation.

ARTICLE 3 – PRODUCTS

The majority of products offered by MATTHIEU TORDEUR EURL to its customers are immediately available. However, not all products sold by MATTHIEU TORDEUR EURL may necessarily be available for sale online.

ARTICLE 4 – ORDERING

Automatic recording systems are considered proof of the nature, content, and date of the Order.

MATTHIEU TORDEUR EURL will confirm acceptance of the customer’s Order by sending a confirmation message to the email address provided by the customer. The sale will only be concluded once this order confirmation has been sent.

MATTHIEU TORDEUR EURL reserves the right to refuse or cancel any Order from a customer, particularly in the event of the customer’s insolvency or in the event of non-payment of the Order in question or a previous delivery, or a dispute relating to the payment of a previous order.

The information provided by the customer when entering the details of their Order is binding. MATTHIEU TORDEUR EURL cannot be held liable for any errors made by the customer in entering the details of the recipient of the Order (delivery address, billing address, etc.) and for any delays in delivery or inability to deliver the Products ordered that these errors may cause.

ARTICLE 5 – DELIVERY

After confirmation of the Order and subject to full payment of the price of the products ordered, MATTHIEU TORDEUR EURL undertakes to ship the products ordered to its customer at the delivery address within a reasonable time, except in exceptional circumstances.

All Products specified in Orders placed with MATTHIEU TORDEUR EURL are intended for the personal use of customers or recipients whose names are mentioned in the delivery address.

Where applicable, the customer undertakes to pay, upon receipt, all taxes, duties, levies, and other charges, present and future, due in respect of the delivery of the said products themselves; MATTHIEU TORDEUR EURL cannot at any time be held jointly and severally liable in this respect.

Customers or recipients of the Products shall refrain from reselling all or part of the Products.

Delivery will be made by La Poste Suivi or Colissimo at our discretion.

For reasons of availability of the Products ordered, an Order may be subject to several successive deliveries to the customer.

If the customer wishes to have the Products ordered delivered to two separate addresses, they must place two separate Orders.

ARTICLE 6 – WITHDRAWAL

The customer has a period of 7 days from receipt of the Products ordered to return them to MATTHIEU TORDEUR EURL for exchange or refund. In this case, the customer must return the Products new, intact, accompanied by any accessories, user manuals, and documentation to the following address:

In the event that the right of withdrawal is exercised, MATTHIEU TORDEUR EURL undertakes to refund the sums paid by the customer, free of charge, with the exception of return shipping costs.

Refunds are due within a maximum period of 14 days.

ARTICLE 7 – PRICE

The price is expressed in euros.

The price indicated on the Product Sheets does not include transportation costs.

The price indicated in the Order confirmation is the final price, including all taxes and VAT. This price includes the price of the Products, handling, packaging and storage costs, transport and commissioning costs.

ARTICLE 8 – PAYMENT

The price invoiced to the customer is the price indicated on the Order confirmation sent by MATTHIEU TORDEUR EURL.

The price of the Products is payable in cash using one of the payment methods offered on the website on the day of the actual order.

The Order validated by the customer will only be considered effective once the secure bank payment center has approved the transaction and, where applicable, after the insurer has agreed to cover the risk.

ARTICLE 9 – REFUND/CANCELLATION POLICY

In the event of a delivery delay exceeding fourteen (14) business days, the Customer may, if they wish, and except in cases of force majeure, terminate the sales contract by registered letter with acknowledgment of receipt. However, this right must be exercised within sixty (60) business days from the delivery date initially specified in the contract.

Upon receipt of the ordered Products, the customer or recipient must check that the delivered goods are in good working order and read the conditions of use set out in the user manual provided.

In the event that one or more of the Products ordered are missing or damaged, the customer or recipient must make any reservations to the carrier at the time of delivery.

ARTICLE 10 – APPLICABLE LAW

These General Terms and Conditions of Sale are subject to French law.

ARTICLE 11 – LIABILITY

MATTHIEU TORDEUR EURL cannot be held liable for damages of any kind, whether material, immaterial, or physical, that may result from the malfunction or misuse of the Products sold.

The liability of MATTHIEU TORDEUR EURL shall, in any event, be limited to the amount of the order. In the event of difficulties in the application of this contract, the customer and MATTHIEU TORDEUR EURL reserve the right, before taking any legal action, to seek an amicable solution.

Otherwise, for business customers, the Paris Commercial Court shall have sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

ARTICLE 12 – WARRANTY

In any event, MATTHIEU TORDEUR EURL cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt. MATTHIEU TORDEUR EURL’s liability is systematically limited to the value of the Product in question determined on the date of its sale, with no possibility of recourse against the brand or the company that manufactured the product.

ARTICLE 13 – CONFIDENTIALITY

The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering Orders, issuing invoices, and drawing up warranty contracts. Failure to provide this information will result in the Order not being validated.

In accordance with the French Data Protection Act, the processing of personal data relating to customers has been declared to the French Data Protection Authority (CNIL).

The customer has (Article 34 of the Law of January 6, 1978) a right to access, modify, rectify, and delete data concerning him/her, which he/she may exercise by contacting MATTHIEU TORDEUR EURL. Furthermore, MATTHIEU TORDEUR EURL undertakes not to disclose its customers’ contact details to third parties, either free of charge or in return for payment.

ARTICLE 14 – INTELLECTUAL PROPERTY

All elements of the MATTHIEU TORDEUR EURL website, whether visual or audio, are protected by copyright, trademarks, or patents.

Therefore, none of the documents originating from the MATTHIEU TORDEUR EURL website may be copied, reproduced, republished, downloaded, posted, transmitted, or distributed in any way whatsoever, except under the following conditions: you may download a copy of the documents onto a computer for your personal use and for non-commercial purposes only, provided that you do not modify the information and that you keep all copyright and other proprietary notices intact. Modification of these documents or their use for any other purpose constitutes an infringement of MATTHIEU TORDEUR EURL’s intellectual property rights.
